Terms of Service

Last updated: 1 November 2026 · Version 1.0

These Terms of Service ("Terms") govern your use of AutoFeed, the social media planner available at https://autofeed.be (the "Service"), provided by AG IT-Solutions, trade name AGITS, legal form, with registered office at registered office address and enterprise number enterprise number ("AGITS", "we", "us").

By creating an account or using the Service, you accept these Terms. If you accept them on behalf of a company or organisation, you confirm that you are authorised to bind it; "you" and "Customer" then refer to that organisation.

1. Who the Service is for

AutoFeed is intended for businesses, organisations and professionals acting for purposes relating to their trade, business, craft or profession. It is not offered to consumers. If you nevertheless use the Service as a consumer, the mandatory consumer protection rules of your country of residence continue to apply and nothing in these Terms limits them.

You must be at least 16 years old to use the Service.

2. Definitions

  • Account – your personal AGITS account (email and password), usable across AGITS apps.
  • Workspace (or "space") – a shared environment in which a Customer manages its brand, content and channels, together with invited Members.
  • Channel – an Instagram account or Facebook page connected to a Workspace.
  • Customer Content – everything you or your Members upload, create or generate in the Service: texts, captions, images, videos, templates, brand assets, comments, chat messages and data retrieved from connected Channels.
  • AI Output – content generated or edited by the Service's AI features.
  • Plan – the subscription tier chosen for a Workspace.

3. Your account

  • Keep your login details confidential and use a strong, unique password. You are responsible for activity under your Account.
  • Provide accurate information and keep your email address up to date: we use it for important notices.
  • Notify us immediately at security@agits.be if you suspect unauthorised access.
  • Do not create Accounts by automated means or on behalf of others without their authorisation.

The Workspace owner decides who becomes a Member and which role they get, and is responsible for the actions of its Members within the Workspace.

4. The Service

AutoFeed lets you plan, create and publish social media content, including: an AI-assisted content calendar, a post editor with AI captions and hashtags, AI image generation and editing, branded templates rendered into images, a media library with AI image descriptions, free stock photo search, scheduling and publishing to Instagram and Facebook, analytics reporting (on paid Plans), team Workspaces and a chat assistant.

We continuously improve the Service and may add, change or remove features. We will not materially reduce the core functionality of a paid Plan during a paid period without at least 30 days' notice; if such a change materially disadvantages you, you may terminate with a pro-rata refund of prepaid fees for the remaining period.

5. Plans, prices and payment

  • Paid Plans are billed monthly in advance via Stripe, per Workspace. All prices are exclusive of VAT and other applicable taxes. Business customers within the EU with a valid VAT number may be invoiced under the reverse-charge mechanism.
  • Subscriptions renew automatically each month until cancelled.
  • You can cancel at any time in the app. Cancellation takes effect at the end of the current billing period; you keep access to the paid features until then.
  • Fees already paid are not refunded for partial months, except where required by law or expressly stated in these Terms.
  • Upgrades take effect immediately; downgrades take effect at the next billing period.
  • If a payment fails, we will notify you and retry. If payment remains outstanding 14 days after our notice, we may downgrade the Workspace to the free Plan or suspend paid features. Late payments by business customers bear interest under the Belgian Act of 2 August 2002 on combating late payment in commercial transactions.
  • We may change prices with at least 30 days' notice. A price change applies from the next billing period after the notice period. If you do not agree, you may cancel before it takes effect.

Agency Plans and custom agreements are governed by a separate order form; in case of conflict, the order form prevails over these Terms.

6. Free Plan

The Explorer Plan is provided free of charge, as is, with the limits shown in the app. We may change or discontinue the free Plan with 30 days' notice. We may delete free Workspaces that have been inactive for more than 12 months, after notifying the owner by email at least 30 days in advance.

7. Fair use and limits

Each Plan includes limits, for example on posts per month, AI generations per month, AI images per month, storage, Members and Channels. The current limits are shown in the app and form part of these Terms. When you reach a limit, the relevant feature may be paused until the next period or until you upgrade.

Beyond these limits, use must remain reasonable and in line with normal use by a business of your size. We may contact you, throttle or temporarily limit usage that puts the stability, security or cost of the Service at risk, such as automated scripting, reselling access or systematically exhausting AI capacity. We will first contact you where reasonably possible.

8. Acceptable use

You must use the Service in compliance with the law, these Terms and our Acceptable Use Policy, which forms part of these Terms.

9. Meta platforms (Instagram and Facebook)

  • Publishing and analytics rely on the APIs of Meta Platforms Ireland Ltd. When you connect a Channel, you must also comply with the Instagram Terms of Use, the Facebook Terms of Service, the Meta Community Standards and Meta's Platform Terms and policies.
  • You must be authorised to manage each Channel you connect.
  • Meta may change, restrict or discontinue its APIs at any time. We are not responsible for failures or limitations caused by Meta (for example rejected posts, API downtime, revoked permissions, rate limits or account restrictions) and we cannot guarantee that a scheduled post will be published at the exact time.
  • You remain responsible for checking that your posts were published as intended.

10. Your content

10.1 Ownership

You retain all rights to your Customer Content. We claim no ownership.

10.2 Licence to us

You grant AGITS a non-exclusive, worldwide, royalty-free licence, for the duration of your use of the Service and the retention periods described in our Privacy Policy, to host, store, copy, process, transform (for example resize, render into templates, generate descriptions), transmit and display Customer Content, solely to provide, secure and support the Service for you, including publishing it to the Channels you instruct. This licence does not allow us to use Customer Content for marketing or to train AI models.

10.3 Your responsibility

You are responsible for your Customer Content and confirm that you have all rights, licences and consents needed for it, including from people who appear in images, and for the brand assets and website you import. You are responsible for the content you publish, including compliance with advertising, consumer protection, influencer disclosure and intellectual property rules.

10.4 Public files

Images that are published must be reachable by Meta via a public URL. Such files are stored at hard-to-guess but publicly accessible URLs and may be cached by our content delivery network.

10.5 Stock photos

Stock photos found through the search feature come from third-party sources under their own free licences. You are responsible for checking and respecting the licence terms (including attribution where required) before using an image.

11. AI features and AI Output

  • AI Output is generated automatically by models of third parties (currently Google Gemini). It may be inaccurate, incomplete, biased, not unique or similar to content generated for others, or infringe third-party rights.
  • You must review AI Output before publishing. You decide what is published and you are responsible for it as if you had written it yourself.
  • If you enable automatic publishing (Settings → Automation), AI Output may be published without prior human review. You choose this mode at your own risk and remain fully responsible for everything published through it.
  • AI Output is not professional advice (legal, financial, medical or otherwise). Strategy suggestions and analytics insights are indicative.
  • Subject to these Terms and the providers' terms, we assign to you whatever rights we may have in AI Output you generate. We give no warranty that AI Output is protected by copyright or free from third-party claims.
  • Do not use AI features to create content prohibited by our Acceptable Use Policy, including deepfakes of real persons without their consent.
  • More in our AI transparency notice.

12. Our intellectual property

The Service, including its software, design, templates, texts and brands (including "AutoFeed" and "AGITS"), belongs to AGITS or its licensors. You receive a limited, non-exclusive, non-transferable right to use the Service during your subscription. You may not copy, reverse-engineer, resell or create derivative works of the Service, except where the law expressly allows it.

Feedback you give us may be used freely to improve the Service, without obligation to you.

13. Personal data

Our Privacy Policy explains how we process data as controller. For personal data in Customer Content we act as processor; our Data Processing Agreement applies automatically and forms part of these Terms.

14. Availability and support

We aim for high availability but do not guarantee uninterrupted or error-free operation. Maintenance is planned outside Belgian business hours where possible. Support is available via support@agits.be on business days. Specific service levels apply only if agreed in writing (e.g. for Agency Plans).

15. Warranties

We provide the Service with due care and in accordance with good professional practice (obligation de moyens / middelenverbintenis). Except as expressly stated in these Terms, and to the extent permitted by law, the Service is provided "as is" and we exclude all other warranties, including fitness for a particular purpose and any guarantee of reach, engagement, follower growth or commercial results.

16. Liability

  1. Our total liability arising out of or in connection with the Service and these Terms, whatever the legal basis, is limited to the fees you actually paid for the Service in the 12 months preceding the event giving rise to the liability. For the free Plan, this means our liability is limited to €0, to the extent permitted by law.
  2. We are not liable for indirect or consequential damage, including loss of profit, revenue, customers, followers, reputation, goodwill or data, or business interruption.
  3. We are not liable for damage caused by Meta, Google or other third-party platforms, by AI Output you published, by your Customer Content, or by force majeure.
  4. These limitations do not apply to liability for fraud, intentional misconduct, death or personal injury, or any liability that cannot be limited under mandatory law.
  5. You indemnify us against third-party claims arising from your Customer Content, your published posts or your breach of these Terms or the Acceptable Use Policy.

17. Suspension and termination

  • By you: you may cancel a subscription or delete your Workspace or Account at any time in the app (see Data deletion).
  • By us, with notice: we may terminate the Service for a Workspace or Account with 30 days' notice, for example if we discontinue the product. Prepaid fees for the period after termination are then refunded.
  • By us, immediately: we may suspend or terminate access without notice if you seriously breach these Terms or the Acceptable Use Policy, if required by law or a platform (such as Meta), or to prevent harm to the Service, other users or third parties. Where reasonable, we will first give you an opportunity to remedy.
  • After termination, your right to use the Service ends. Sections that by their nature should survive (including 10.3, 11, 12, 16, 19) remain in force.

18. Data export and deletion after termination

  • You can download your media files from the media library at any time. For a full export of your Workspace content in a structured format, email support@agits.be; we will provide it within a reasonable time, at no cost once per Workspace per year and at termination.
  • After deletion of a Workspace or Account, Customer Content is deleted within 30 days and removed from rotating backups within 35 days, except where we must keep data by law (such as invoices). See Data deletion.
  • Please export what you need before deleting your Workspace.

19. Changes to these Terms

We may amend these Terms. We will notify you of material changes by email or in the app at least 30 days before they take effect. If you do not agree, you may cancel before the effective date; cancelled paid subscriptions are then refunded pro rata for the remaining prepaid period. Continued use after the effective date means you accept the new Terms. Changes required by law or by a platform may take effect sooner.

20. General

  • Assignment: you may not transfer your rights under these Terms without our consent. We may transfer them in the context of a merger, acquisition or transfer of business, with notice to you.
  • Force majeure: neither party is liable for failure caused by events beyond its reasonable control, including outages of third-party platforms or cloud providers.
  • Severability: if a provision is invalid, the rest remains valid and the invalid provision is replaced by a valid provision that comes closest to its intent.
  • No waiver: failing to enforce a right is not a waiver.
  • Entire agreement: these Terms, together with the documents referred to in them, form the entire agreement regarding the Service.
  • Notices: we send notices to the email address of the Account or Workspace owner. You can reach us at hello@agits.be.
  • Language: these Terms are available in English and Dutch. Both language versions are equally authoritative.

21. Governing law and disputes

These Terms are governed by Belgian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. We will first try to resolve any dispute amicably; contact hello@agits.be. Failing that, disputes fall under the exclusive jurisdiction of the courts of the judicial district where AG IT-Solutions has its registered office, without prejudice to mandatory rules that grant jurisdiction to other courts.
